Aims and Objectives:

To ensure relevant staff have knowledge and understanding of the deprivation of liberty safeguards (DoLS) implemented in April 2009

•         Refresh understanding of the principles, section 5 and section 6 (restraint) of the Mental Capacity Act
•         Identify the purpose of the deprivation of liberty safeguards
•         Consider the judgment of the ECtHR in the HL v the United Kingdom (Bournewood) case
•         Identify factors that can amount to a deprivation of liberty
•         Explore the process of authorisation
•         Consider the six assessments, their purposes and who can undertake them
•         Understand the possible length of authorisations
•         Discuss the role of the relevant person's representative
•         Identify when an IMCA should be instructed
•         Identify when reviews must take place
•         Become aware of standard forms and letters
•         Consider issues of consultation and information giving
•         Apply some of the learning to a practice example
